Why Title Due Diligence Matters
Acquiring real estate in Nigeria without rigorous title verification exposes buyers to adverse ownership disputes, government acquisitions, and boundary litigations. At AGS, our legal compliance team subjects every listed property to a 4-tier title verification protocol.
1. Certificate of Occupancy (C of O)
A C of O is a primary title document issued by the State Government, granting the holder 99-year leasehold rights over the designated land parcel. It proves legitimate state recognition.
2. Governor's Consent
Whenever a property with an existing C of O is subsequently sold or transferred, the Land Use Act mandates that the Governor of the State must consent to the transaction for the title deed to be legally perfected.
3. The Government Gazette
A Gazette is an official government record detailing lands excised to indigenous communities or acquired for public infrastructure. Properties excised from acquisition carry secure, marketable titles.
